Mobile App Privacy Policy

Introduction

Power Leasing Systems, Inc. and its affiliated entities (“PLS” or “we”) are committed to protecting the privacy of individuals and achieving and maintaining the trust of our leasing professional and apartment community clients (“PLS Clients”). This policy describes:

  • The types of information we may collect or that PLS Clients may provide when they purchase, download, install, register with, access or use Power Pro iPad Leasing System (the “App”).
  • PLS’s practices for collecting, using, maintaining, protecting and disclosing that information, including the personal data provided by individuals (e.g., potential renters) to PLS Clients.

This policy applies only to information we collect in the App and in email, text, and other electronic communications sent through or in connection with the App (for example, the App’s in-app chat feature).

This policy DOES NOT apply to information that:

  • We collect offline or on any other PLS apps or websites, including websites you may access through the App.
  • You provide to or is collected by any third party (see Third-Party Information Collection).

PLS websites and other apps, and these other third parties, have their own privacy policies. We encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding the information we receive through the App, and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the App. By downloading, registering with, or using the App, PLS Clients agree to this privacy policy.  

PLS CLIENTS ARE RESPONSIBLE FOR THE PRIVACY OF ALL PERSONAL INFORMATION OF THEIR OWN CUSTOMERS. THIS SHOULD INCLUDE DISCLOSING THE INFORMATION CONTAINED IN THIS PRIVACY POLICY TO SUCH CUSTOMERS, AS WELL AS THE PLS CLIENT’S EMPLOYEES, VENDORS AND OTHER AFFILIATES.

This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

 

Description of the App

The Power Pro iPad Leasing System is designed to enhance the consumers’ apartment search and leasing experience while also enabling the leasing professional to become more efficient in the apartment leasing and management processes. Predicated on customer-centric needs, the App is designed to raise closing ratios and increase leases for everyone from the greenest to the most senior leasing professionals.  When integrated with the PLS Clients’ property management software on site, that means single entry data and real time information.

Children Under the Age of 18

The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18.  If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at privacy@powerproleasing.com.

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see Your California Privacy Rights for more information.

Users Outside of the United States

The App and its services are hosted in the United States and are governed by the laws of the United States. PLS does not intend the App to be downloaded, accounts registered by, or used by users outside the United States, and does not market to users outside the United States. If you are using the App outside the United States, please be aware that your information will be transferred to, stored and processed in the United States where PLS’s servers and databases are located (therefore transferred outside the European Union (“EU”) and European Economic Area (“EEA”)). By using the App, you consent to the transfer of information to countries outside your country of residence.

Information We Collect and How We Collect It

We collect information from and about users of the App:

  • Directly from PLS Clients when they provide it to us.
  • Automatically when PLS Clients use the App.
  • Third party internet apartment listing services (such as Apartments.com), where PLS Clients receive email leads from prospective renters.
  • Third party property management software platforms (such as Yardi, RealPage and I Love Leasing).

Information You Provide to Us  

When you download, register with, or use the App, we may ask you provide information:

  • By which PLS Clients and their customers may be personally identified, such as name, postal address, email address, telephone numbers or user uploads (“personal information”).
  • That is about PLS Clients and their customers but individually does not identify them, such as device IDs, usage history or past logins.

This information includes:

  • Information that PLS Clients provide by filling in forms in the App. This includes information provided at the time of registering to use the App, subscribing to PLS’s service, posting material, and requesting further services. We may also ask PLS Clients for information when they report a problem with the App.
  • Records and copies of PLS Clients’ correspondence (including email addresses and phone numbers, in-app chat logs), if they contact us.
  • Details of transactions PLS Clients carry out through the App and of the fulfillment of PLS’s services, such as the creation of guest cards and communication logs with prospective renters.

Automatic Information Collection and Tracking

When PLS Clients download, access and use the App, it may use technology to automatically collect:

  • Usage Details. When PLS Clients access and use the App, we may automatically collect certain details of their access to and use of the App, including traffic data, logs, and other communication data and the resources that PLS Clients access and use on or through the App.
  • Device Information. We may collect information about PLS Clients’ mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on a PLS Client’s device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
  • Location Information. This App does NOT collect real-time information about the location of a PLS Client’s device.

If you, as a PLS Client, do not want PLS to collect this information, do not download or use the App, or delete it from your device.

Information Collection and Tracking Technologies

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on a PLS Client’s device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of the App.
  • Crash Reporting. Crash reporting creates detailed reports of the errors in the App. Errors are grouped into clusters of similar stack traces and triaged by the severity of impact on users. We may also log custom events to help capture the steps leading up to a particular crash in the App.

 

Third-Party Information Collection

When you use the App, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • Your mobile device manufacturer.
  • Your mobile service provider.
  • Property management software platforms that integrate with the App, such as Yardi, Real Page, and I Love Leasing.

These third parties may use tracking technologies to collect information about you, as a PLS Client, when you use the App, and your customers and other potential renters. The information they collect may be associated with your personal information or your customers’ personal information, or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

WE DO NOT CONTROL THESE THIRD PARTIES’ INFORMATION COLLECTION TECHNOLOGIES, TRACKING TECHNOLOGIES, OR HOW THEY MAY BE USED. THESE THIRD PARTIES HAVE THEIR OWN PRIVACY POLICIES, WHICH WE ENCOURAGE YOU TO READ BEFORE PROVIDING INFORMATION ON OR THROUGH THEM. If you have any questions about an advertisement or other targeted content on your device, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about PLS Clients or that they provide to PLS, including any personal information belonging to a customer of a PLS Client, to:

  • Provide you with the App and its contents, and any other information, products or services that PLS Clients request from us.
  • Fulfill any other purpose for which PLS Clients provide it.
  • Give PLS Clients notices about their account or subscription, including expiration and renewal notices.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between PLS Clients and PLS, including for billing and collection.
  • Notify PLS Clients when updates for the App are available, and of changes to any products or services we offer or provide though it.

The usage information we collect helps us to improve the App and to deliver a better experience for PLS Clients and their customers by enabling PLS to:

  • Estimate our user size and usage patterns.
  • Store information about PLS Clients’ preferences, allowing us to customize the App according to their individual needs and business practices.
  • Recognize PLS Clients when they use the App.

Disclosure of Your Information

We disclose aggregated information about users of the App and information that does not identify any individual or device without restriction.

In addition, we disclose personal information that we collect, including personal information provided by PLS Clients:

  • To PLS’s subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of PLS’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by PLS about the App’s users is among the assets transferred.
  • To fulfill the purpose for which PLS Clients provide it. For example, if a PLS Clients gives us an email address of a potential renter, we may transmit that email address to third party property management vendors, including but not limited to Yardi , I Love Leasing and RealPage .
  • For any other purpose disclosed by PLS when they provide the information.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, including the App’s EULA , terms of sale, and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of PLS, PLS’s customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

While we cannot control our third party vendors’ collection or use of PLS Clients’ information or the information regarding PLS Clients’ customers, these third parties may provide you with ways to choose not to have your information collected or used. Please contact these third party vendors for additional information on their practices, policies and opt-out rights.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide PLS Clients with choices regarding the personal information they choose to provide to PLS. This section describes mechanisms we provide for them to control certain uses and disclosures of over their information and the information provided by PLS Clients or their customers.

  • Tracking Technologies. You can choose whether or not to allow the App to collect information through other tracking technologies through the device’s privacy setting or by disabling or fusing cookies. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings.  If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

Accessing and Correcting Your Personal Information

PLS Clients can review and change their personal information by logging into the App and visiting their account profile page.

PLS Clients may also send us an email at privacy@powerproleasing.com to request access to, correct, or delete any personal information that they have provided to PLS. We may not be able to delete all personal information of a PLS Client except by also deleting their user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

If a PLS Client or a customer of a PLS Client is a California resident, California law may provide them with additional rights regarding our use of personal information. To learn more about your California privacy rights, visit CCPA PRIVACY NOTICE FOR CALIFORNIA RESIDENTS.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the App who are California residents to request certain information regarding PLS’s disclosure of personal information to third parties for direct marketing purposes. PLS DOES NOT DISCLOSE PERSONAL INFORMATION TO THIRD PARTIES FOR SUCH PURPOSES. To make such an inquiry however, please send an email to privacy@powerproleasing.com.

Data Security

We have implemented measures designed to secure the information provided to PLS by PLS Clients from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on each PLS Client and their own practices regarding their customers’ personal information. Where we have given a PLS Client a password for access to certain parts of the App, they are responsible for keeping this password confidential. We ask each and every PLS Client not to share their password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of the information provided by PLS Clients through the App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our the personal information of PLS Clients or their customers, we will post the new privacy policy on this and notify you either by email to the email address specified in the PLS Client’s account, or with an in-App alert the first time you use the App after we make the change.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
